This Privacy Policy explains how your personal data is collected, used and protected when you visit jayscotts-europe.com (the "Website"), register for a trade account, or otherwise contact us. We are committed to processing personal data in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR") and applicable Hungarian data-protection law.

We have not appointed a statutory Data Protection Officer (DPO), as we are not required to do so under Article 37 GDPR. You can address any data-protection question to the contact above.

2. What personal data we collect

Depending on how you interact with us, we may process the following categories of personal data:

a) Trade-account registration. First and last name, job title, telephone number, email address, company name, company website, your industry/segment (e.g. landscape design, interiorscaper, hospitality, landscape architect, nursery/garden centre, property management, condo association, architect), VAT and EU VAT numbers, and billing and shipping addresses (name, country, postal code, city, street, house number and any additional address details). You also set an account password, which we store only in encrypted/hashed form.

b) Contact and enquiry forms. The name, email, phone, country, address and message details you submit.

c) Account and order data. Information generated while you use your trade account, including your assigned trade terms and any orders, quotations or samples you request.

d) Correspondence. The content of emails, messages and other communications between us.

e) Technical and usage data. IP address, browser and device information, and cookie data collected automatically when you use the Website (see Section 6).

We do not knowingly collect special categories of personal data, and the Website is intended for business (B2B) use, not for consumers or minors.

3. Why we use your data and our legal bases

Where we rely on legitimate interest, we have balanced that interest against your rights and freedoms. You may object to such processing at any time (see Section 9).

4. Who we share your data with

We do not sell your personal data, and we do not share it with third parties for their own marketing. We share data only with:

  • Service providers (processors) acting on our instructions, such as our website and email hosting provider (see Imprint), IT and security providers, and analytics providers.
  • Our payment provider, SimplePay (OTP Mobil Ltd.), for processing card and online payments. Where you pay by card/online, your name, email, telephone, billing address and shipping address are transferred to SimplePay as data processor (see simplepay.hu/adatkezelesi-tajekoztatok).
  • Logistics partners (e.g. our carrier), where needed to deliver an order.
  • Professional advisers, auditors and authorities, where required by law or to establish, exercise or defend legal claims.

All processors are bound by written agreements requiring appropriate confidentiality and security measures in line with Article 28 GDPR.

5. International transfers

Where a service provider processes data outside the European Economic Area (for example, certain analytics or infrastructure services), we ensure an appropriate safeguard is in place, such as an European Commission adequacy decision or the EU Standard Contractual Clauses. You may request further information using the contact details in Section 1.

6. Cookies

The Website uses cookies and similar technologies. Strictly necessary cookies are required for the Website and your account to function and do not require consent. Analytics and marketing cookies (including those set via Google Tag Manager / Google services) are only placed with your consent, which you give through our cookie banner and can withdraw at any time via your browser settings or the cookie settings on the Website. 7. How long we keep your data

We keep personal data only for as long as necessary for the purposes set out above:

  • Trade-account data: for the duration of your account, and for a reasonable period afterwards in case of reactivation or legal claims [confirm period, e.g. up to 5 years].
  • Enquiries that do not lead to a relationship: [confirm period, e.g. up to 1 year].
  • Accounting and invoicing documents: retained for 8 years as required by the Hungarian Act on Accounting (Act C of 2000).
  • Marketing consent records: until you withdraw consent, plus a short period to evidence the withdrawal.

When data is no longer needed, it is securely deleted or anonymised.

8. How we protect your data

We apply appropriate technical and organisational measures to protect personal data against unauthorised access, loss, alteration or disclosure, including access controls, encryption of credentials, secure transmission (TLS) and restricted internal access on a need-to-know basis.

9. Your rights

Under the GDPR you have the right to:

  • Access your personal data and obtain a copy;
  • Rectify inaccurate or incomplete data;
  • Erase your data ("right to be forgotten");
  • Restrict processing in certain circumstances;
  • Object to processing based on legitimate interest, and to direct marketing at any time;
  • Data portability — receive your data in a structured, machine-readable format;
  • Withdraw consent at any time, without affecting the lawfulness of processing before withdrawal.
